Terms of Service

Last updated 2026-09-27 (rev 2)

By creating an account or using FitForAudit (fitforaudit.com.au, fitforaudit.com, and related services), you agree to these Terms of Service and our Privacy Policy on behalf of yourself and the organisation you represent. If you do not agree, do not use the service.

1. What FitForAudit is

FitForAudit is a software-as-a-service platform that helps NDIS registered providers track their compliance against the NDIS Practice Standards, organise evidence, and generate audit-ready evidence packs.

FitForAudit is not affiliated with, endorsed by, or acting on behalf of the NDIS Quality and Safeguards Commission or the National Disability Insurance Agency. We are an independent software vendor. Using FitForAudit does not guarantee a successful audit outcome or NDIS Commission approval.

FitForAudit is an enabler, not a guarantor

You — the registered NDIS provider — are, and remain, solely responsible for your organisation's compliance with the NDIS Practice Standards, the NDIS Act, and every other law or regulatory obligation that applies to you. FitForAudit is a tool that helps you organise, track, and prepare evidence — we do not audit, certify, verify, or guarantee your compliance. If your organisation fails an audit or otherwise fails to meet a compliance obligation, that is not by itself a failure of the Service.

2. Accounts, free trial, and subscriptions

  • You must provide accurate information when creating an account and keep your login credentials confidential.
  • New accounts receive a 14-day free trial with no credit card required. If the trial ends without a payment method being added, access to your account is suspended.
  • Paid subscriptions are billed via Stripe on the plan and billing cycle you select at checkout.
  • You are responsible for all activity under your organisation's account, including actions taken by team members you invite.

Founding customer offer

  • The first 20 organisations to claim the offer while on a paid subscription get 30% off their subscription fees. If a founding customer's subscription ends, we may offer their place to another paying customer, so no more than 20 organisations hold the discount at any time.
  • The discount applies to every plan you're on, including upgrades and downgrades, for as long as your subscription stays continuously active. If the subscription is cancelled or lapses (for example after an unresolved failed payment), the discount ends and doesn't carry over to a new subscription.
  • One discount per organisation. It can't be transferred or exchanged for cash, and it can't be combined with other discounts.
  • Our standard prices may change over time. You'll always get 30% off the price that applies to your plan, and we'll give you at least 14 days' notice of any price change.

3. Acceptable use

You agree not to:

  • Use FitForAudit for any unlawful purpose, or in a way that infringes others' rights
  • Attempt to gain unauthorised access to another organisation's data or to FitForAudit's systems
  • Upload malicious code, or content you do not have the right to upload
  • Upload unredacted personal information about NDIS participants where not necessary for the compliance evidence being recorded — you remain responsible for your own obligations regarding any such information you choose to store with us
  • Resell, sublicense, or provide access to FitForAudit to any third party outside your own organisation without our written consent

4. Your data — ownership, access, and export

  • You own the data you upload. FitForAudit does not claim ownership of your organisation's compliance evidence, checklist content, or records.
  • If your trial ends without converting, or your subscription is cancelled, your data is retained for 30 days before permanent deletion. During that window you can generate and download an audit pack of your evidence, or contact us to request your data, and you can restore full access at any time by adding a payment method or resubscribing.
  • We make reasonable efforts to maintain the availability and integrity of your data, but as with any software service, we do not guarantee uninterrupted availability.

5. Intellectual property

FitForAudit, its software, and design remain our property or that of our licensors. The NDIS Practice Standards content is licensed under CC BY 4.0 AU from the Commonwealth of Australia. These terms do not grant you any rights to our intellectual property beyond the right to use the service as intended.

6. Disclaimers and limitation of liability

  • FitForAudit is provided "as is." We do not warrant that the service will be error-free, uninterrupted, or that it guarantees any particular audit or compliance outcome.
  • To the maximum extent permitted by the Australian Consumer Law, our total liability for any loss arising from your use of the service is limited to the total fees you paid us in the 12 months before the claim arose.
  • Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

7. Term and termination

You may cancel your subscription at any time. We may terminate for material breach of these terms, with reasonable written notice and opportunity to cure, except for serious violations (e.g. unlawful use, security threats) where immediate suspension may be justified.

8. Changes to these terms

We may update these terms from time to time. We will notify account owners by email at least 14 days before any material change takes effect.

9. Governing law

These terms are governed by the laws of New South Wales, Australia.
